1. Introduction
Welcome to CBTSky, a learning marketplace and LMS platform operated as a brand under Network Hosting Group.
These Terms and Conditions govern your access to and use of CBTSky, including learner accounts, instructor accounts, course enrollment, instructor onboarding, course publishing, course sales, payments, commissions, payouts, certificates, support, and related services.
By using CBTSky, creating an account, enrolling in a course, purchasing a course, requesting instructor onboarding, publishing a course, or using any platform feature, you agree to these Terms and Conditions.
If you do not agree with these Terms, you must not use the platform.
2. Nature of Platform
CBTSky is an online learning marketplace where approved instructors can publish and sell their courses, and learners can enroll in those courses.
CBTSky provides the technology platform, LMS dashboard, course listing system, enrollment system, payment collection support, instructor onboarding system, and related platform services.
Unless a course is specifically created or published by CBTSky itself, the course content, teaching, accuracy, updates, quality, support, promises, certificates, and learner outcomes are primarily the responsibility of the respective instructor.
CBTSky acts as a platform facilitator and may collect course fees from learners on behalf of instructors. After applicable deductions, commission, charges, taxes, disputes, or adjustments, CBTSky may settle eligible instructor earnings according to its payout rules.
3. Definitions
In these Terms:
“Platform” means the CBTSky website, LMS, learner dashboard, instructor dashboard, course marketplace, payment system, and related services.
“User” means any person using the platform, including learners, instructors, visitors, or account holders.
“Learner” means a user who enrolls in, purchases, accesses, or studies a course.
“Instructor” means a user whose instructor onboarding request has been approved by CBTSky and who is allowed to publish or sell courses on the platform.
“Course” means any paid or free educational content, including videos, live classes, notes, PDFs, quizzes, assignments, projects, downloadable files, certificates, or other learning material.
“Course Fee” means the amount paid by a learner for enrolling in a paid course.
“Commission” means the platform fee, service charge, sale commission, onboarding charge, transaction charge, or any other deduction payable to CBTSky.
4. User Accounts
Users may create accounts as learners. A learner may request to become an instructor, but instructor access is not automatic.
You agree to provide true, complete, and updated information during registration, course enrollment, instructor onboarding, payment, payout setup, and support communication.
You are responsible for keeping your username, password, OTP, and account access secure. You must not share your account access with any other person.
CBTSky may suspend, restrict, or terminate any account if we find false information, suspicious activity, account sharing, misuse, policy violation, fraud risk, legal risk, or behavior harmful to the platform.
5. Learner Responsibilities
Learners are responsible for carefully reviewing course details before enrollment or payment.
Before purchasing any course, learners should check:
- Course title and description
- Instructor details
- Syllabus and modules
- Course language
- Course duration
- Course access validity
- Live or recorded format
- Certificate availability
- Requirements and eligibility
- Price and applicable charges
- No Refund Policy
Once payment is made, the learner agrees that the purchase is final according to the No Refund Policy.
Learners must not copy, record, download, resell, distribute, upload, share, or misuse any course content unless specifically allowed by the platform.
6. Instructor Onboarding
Any learner may request to become an instructor. Instructor onboarding is available only on request and approval.
Submitting an onboarding request does not guarantee approval. CBTSky may approve, reject, delay, hold, suspend, or cancel an onboarding request at its discretion.
CBTSky may ask for additional details before approval, including identity details, qualification details, experience details, teaching samples, course plan, bank details, tax details, or other required information.
After approval, the learner may see the instructor onboarding process, instructor dashboard, course publishing tools, payout settings, and related features in their panel.
CBTSky may charge instructor onboarding fees, platform fees, listing fees, subscription fees, promotional fees, commission, or other charges as per company policy.
7. Instructor Responsibilities
Instructors are responsible for the courses they create, upload, publish, sell, and manage on CBTSky.
Every instructor agrees that:
- Their course content is original, lawful, and accurate.
- They have full rights or permission to use and publish the course material.
- They will not upload copied, pirated, illegal, misleading, harmful, or prohibited content.
- They will not violate copyright, trademark, privacy, publicity, or third-party rights.
- They will provide correct course descriptions, syllabus, pricing, access details, and learner expectations.
- They will not make false promises about jobs, income, placement, certificates, government recognition, or guaranteed results.
- They will provide reasonable support to enrolled learners where required.
- They will not misuse learner data.
- They will not contact learners for direct payment outside CBTSky.
- They will not bypass platform commission.
- They will comply with applicable laws, tax rules, platform policies, and content guidelines.
CBTSky may remove courses, hold payouts, suspend instructor access, or terminate instructor accounts if any violation, complaint, copyright issue, legal issue, quality issue, or platform risk is found.
8. Course Publishing and Approval
Instructors may submit courses for publishing after approval of their instructor account.
Course submission does not guarantee approval, publication, visibility, promotion, ranking, sale, or continued availability.
CBTSky may review, approve, reject, edit, hide, unpublish, suspend, or remove any course at its discretion.
A course may be rejected or removed due to:
- Poor quality
- Incomplete information
- Misleading claims
- Copyright concerns
- Illegal or prohibited content
- Offensive or harmful material
- Learner complaints
- Payment dispute risk
- Low-quality teaching
- Platform policy violation
- Legal or reputational risk
- Business reasons
CBTSky is not required to provide detailed reasons for every course approval, rejection, suspension, or removal.
9. Course Fees, Commission, and Deductions
Course pricing may be set by the instructor, CBTSky, or both, depending on platform policy and course agreement.
CBTSky collects course fees from learners on behalf of instructors and deducts applicable commission, platform charges, payment gateway charges, transaction fees, taxes, promotional discounts, dispute amounts, chargebacks, penalties, adjustments, or other applicable deductions before instructor settlement.
The instructor agrees that CBTSky has the right to deduct its commission and charges from course sales before making payout.
Commission rates, onboarding fees, payout cycles, minimum payout limits, and deduction rules may be updated by CBTSky from time to time.
10. Instructor Payouts
Instructor earnings become eligible for payout only after successful payment confirmation, deduction of applicable commission and charges, completion of required verification, and clearance of disputes or risk checks.
Payouts may depend on:
- Minimum payout threshold
- Payout cycle
- Correct bank details
- KYC or verification status
- Tax details
- Course sales records
- Refunds or disputes where legally required
- Chargebacks
- Learner complaints
- Fraud checks
- Platform policy compliance
CBTSky may hold, delay, adjust, reverse, or cancel payouts if there is any dispute, incorrect information, legal risk, copyright complaint, learner complaint, fraud suspicion, payment gateway issue, tax issue, instructor violation, or platform misuse.
Instructors are responsible for providing correct payout details. CBTSky is not liable for payout delay or loss caused by incorrect or incomplete information provided by the instructor.
11. Taxes and Compliance
Learners and instructors are responsible for providing accurate billing, identity, and tax-related information where required.
Instructors are responsible for their own income tax, GST, professional tax, filings, invoices, returns, and other legal obligations arising from earnings through the platform.
CBTSky may deduct, collect, or report applicable taxes, TDS, GST, platform charges, or statutory deductions where required by law or business policy.
12. No Refund Policy
CBTSky follows a strict No Refund Policy.
All purchases, course fees, instructor onboarding fees, platform fees, listing fees, promotional fees, subscription fees, and paid services are final and non-refundable unless otherwise required by applicable law or expressly approved by CBTSky in writing.
Learners and instructors must read the separate No Refund Policy before making any payment.
13. Course Access
Course access may be lifetime, limited-time, subscription-based, batch-based, instructor-controlled, or otherwise defined on the course page.
CBTSky does not guarantee permanent availability of any instructor-created course.
Course access may be restricted, suspended, or removed if:
- Course validity expires
- Payment fails or is reversed
- User violates platform policy
- Instructor removes or updates the course
- Course is removed due to complaints or legal risk
- Copyright issue arises
- Platform service changes
- CBTSky decides to discontinue a course or feature
14. Certificates
Some courses may include certificates. Certificate availability, eligibility, format, verification, and issuance depend on course rules, instructor settings, platform policy, completion status, assignment status, quiz performance, payment status, and approval.
A certificate issued through CBTSky is not a degree, diploma, government certificate, professional license, job guarantee, placement guarantee, or income assurance unless specifically stated in writing.
CBTSky may deny, cancel, correct, revoke, or verify certificates in case of false information, cheating, account sharing, misuse, technical error, or violation of platform rules.
15. Result Disclaimer
CBTSky and instructors provide education and learning support only.
We do not guarantee:
- Job placement
- Freelance work
- Business income
- Salary increase
- Exam success
- Client acquisition
- Promotion
- Course completion result
- Certificate acceptance by third parties
- Any specific academic, financial, professional, or career result
Learner success depends on personal effort, practice, skill level, discipline, market conditions, instructor quality, and other factors outside CBTSky’s control.
16. Intellectual Property
CBTSky owns or controls its platform design, brand name, logo, LMS structure, website layout, technology, system features, and company-created content.
Instructor-created course content remains the responsibility of the instructor. By uploading or publishing content on CBTSky, the instructor grants CBTSky a non-exclusive, worldwide, royalty-free right to host, display, stream, market, promote, sell, distribute, format, and make the content available through the platform.
Learners receive only a limited, personal, non-transferable, non-commercial right to access enrolled course content. Learners do not receive ownership of any content.
17. Prohibited Activities
Users must not:
- Share login details
- Copy, record, resell, or distribute course content
- Upload pirated or copyrighted content without permission
- Bypass CBTSky payment or commission
- Contact learners for unauthorized direct payment
- Create fake reviews, fake enrollments, or fake certificates
- Abuse, threaten, harass, or mislead users
- Upload spam, malware, or harmful files
- Hack, scrape, reverse-engineer, or overload the platform
- Misuse learner or instructor data
- Make false claims against CBTSky
- Violate applicable law or platform policy
Violation may result in account suspension, course removal, payout hold, legal action, or permanent ban.
18. Reviews and Feedback
Learners may submit course reviews, ratings, comments, or feedback where enabled.
CBTSky may moderate, remove, hide, reject, or edit reviews that are fake, abusive, offensive, promotional, misleading, irrelevant, legally risky, or against platform policy.
CBTSky may use reviews and testimonials for platform improvement, quality control, and marketing.
19. Platform Rights
CBTSky reserves the right to change, update, suspend, discontinue, or restrict any platform feature, course listing, pricing rule, commission plan, payout rule, onboarding rule, policy, service, or account access.
CBTSky may take action without prior notice where required for security, compliance, technical reasons, legal risk, learner protection, instructor quality, brand reputation, or business interest.
20. Third-Party Services
CBTSky may use third-party services such as payment gateways, hosting providers, live class tools, video platforms, analytics tools, email providers, SMS/WhatsApp providers, or other integrations.
CBTSky is not responsible for third-party downtime, delay, errors, privacy practices, charges, payment failure, service quality, or technical issues.
21. Limitation of Liability
To the maximum extent permitted by law, CBTSky, Network Hosting Group, owners, employees, partners, representatives, and service providers shall not be liable for any direct, indirect, incidental, financial, educational, technical, data-related, business, or consequential loss arising from the use of the platform.
CBTSky is not liable for instructor-created content, learner decisions, course outcomes, payment gateway delays, payout delays, missed classes, technical issues, third-party services, or expected results from any course.
If any liability is established, the maximum liability of CBTSky shall not exceed the platform commission actually received by CBTSky from the specific disputed transaction.
22. Indemnity
You agree to indemnify and protect CBTSky, Network Hosting Group, its owners, employees, partners, representatives, and service providers from any claim, loss, complaint, liability, cost, damage, or legal action arising from:
- Your misuse of the platform
- Your violation of these Terms
- Your course content
- Your learner or instructor activity
- Your false information
- Your payment dispute
- Your tax or legal non-compliance
- Your violation of third-party rights
- Your violation of applicable law
23. Governing Law and Jurisdiction
These Terms shall be governed by the laws of India.
Any dispute related to the platform, course purchase, instructor payout, user account, content, commission, payment, or these Terms shall be subject to the jurisdiction of competent courts in Sonipat, Haryana, India, unless otherwise required by applicable law.
